Three Insurance took 39 days to make a decision on my claim

I had an auto accident where I was hit by a Taxi that turned into me as I was driving from a parked position. It was very much NOT my fault, should be an easy fix, right? I made my claim on 11/11/2022. It took Three Insurance 39 days AND a complaint to the Department of Insurance to finally make a decision about my Van. I had an auto accident where I was hit by a Taxi that turned into me as I was driving from a parked position. It was very much NOT my fault, should be an easy fix, right? I made my claim on 11/11/2022. It took Three Insurance 39 days AND a complaint to the Department of Insurance to finally make a decision about my Van. (I finally got my van back a few days ago, almost 45 days later). The time it took isn't the only issue, my biggest issue with Three Insurance is that they LIED to me and told me that I would be responsible, out of my collision coverage, to pay ALL storage fees accumulated while my Van was waiting for its verdict of totalled or not totalled. The laws and regulations for California CLEARLY state that is not aloud and that the insurance companies are responsible, which I am sure Three knew about. As soon as I was made aware of the storage fee issue, (within the first week of my claim) I contacted Three and expressed my concern with how long things were taking. I expressed this concern multiple times over the next couple weeks over the phone and email, I was incredibly stressed out by this. The storage fees were $250 a day, not to mention I was paying for the collision coverage on the rental which was $25 a day, and adding up quickly. I eventually had to turn the rental back in because I was out $600 and counting and couldn't afford any more out of pocket cost, especially with the idea of paying ALL storage fees looming over me. So, I ended up carless for weeks as a result. Three hasn't offered to cover any of those out of pocket cost, which should have been minimal should they have done their jobs in a reasonable length of time. When I called them out in an email letting them know I knew the laws and regulations, they ignored that they told me I should pay for it, and immediately told the body shop to fix the van (with out ever receiving the appraisal information). They were simply trying to save their [REDACTED WORD] because they dragged their feet and thought that I was dumb enough to pay over 10,000 in fees AND loose my vehicle all together. I imagine they have pulled this on other people, considering they were willing to take it as far as they did. To their avail, I did loose money not having a car since my van is my work vehicle (also expressed many times), so they sent me a check out of some fund to cover that cost, so that was nice after almost 2 months of complete stress over this situation. I did not feel that Three advocated for me AT ALL. In fact, they still were willing to make me pay out of pocket should the cost of my repairs need a supplement and go over my collision coverage. In that case it would have meant my car was a total loss and they owe the fees, but they would have made me pay for it instead. They were only in it for themselves, and I had to spend many hours of my days figuring out how to navigate this situation. Sure, they were nice on the phone, but ultimately it was a disaster. I thought insurance was there to advocate for you and take the stress off your situation. Thats why I pay them $320 a month. Hoping this business gets it together. The idea of it is nice, all your insurance in one place with out killing your wallet. I am going to live out the rest of my current policy with them now that I know how to further navigate situations like this, but I find it important to hold companies accountable when they willingly deny the truth and try to take advantage of their clients.
